MEMORANDUM NO. ERR-04-086

To: Deans, Directors, Head of Units

Subject: Institutional Projects Requiring the 
 Chancellor as Signatory

In light of recent events involving the alleged “privatization” 
 by College Foundations of what are clearly institutional projects, 
 this Memorandum reiterates the warning previously given to all 
 deans and other responsible officials of UP Diliman that 
 the Chancellor is the only person authorized by the Board of 
 Regents to enter into contracts binding upon UP Diliman.

Thus, where the funding source contemplates the project to be 
 undertaken as an institutional commitment of UP Diliman, the 
 covering agreement must be executed by the Office of the 
 Chancellor and the Funding Agency. Otherwise, UP Diliman 
 shall disown any and all outputs as well as any and all 
 liabilities arising from the same. UP Diliman may also 
 actively prosecute the appendage of its name in any material 
 or end product that was not undertaken as an institutional commitment.

All donations, whether financial or property, made by the 
 College Foundations to their Colleges or any other units of 
 UP Diliman must be contained in a Report to the Office of the 
 Chancellor duly covered by Deeds of Donation, copy furnished 
 the Supply and Property Management Office (SPMO) and/or the 
 Resident COA Auditor’s Office for recording and/or issuance 
 of memorandum receipt/s.
